General terms and conditions of sale

PREMESSE

Armond Srl (hereinafter referred to as “Armond” for brevity) markets products bearing the “Armond” brand in Italy, Switzerland and England.
Always attentive to meeting its customers’ expectations, Armond has decided to set up, alongside its network of direct and exclusive sales outlets, a distance selling network for some of its products, via telephone or through the armond.com website.
The system, which requires active participation by the Customer, has been developed in full compliance with the regulations governing distance selling and, in particular, Articles 45 et seq. of the Consumer Code (Legislative Decree No. 206 of 6 September 2005, as amended).
Armond does not call customers on its own initiative to offer distance selling of products, unless this concerns a request made in advance by the customer.

The use of the distance selling service described in these general terms and conditions of sale is reserved exclusively for consumers, as defined by law and case law, meaning natural persons acting for purposes not related to their commercial, entrepreneurial or professional activities, if any, and residing in Italy (hereinafter referred to as “Customers” for brevity).

SCOPE OF APPLICATION

These general terms and conditions of sale apply to all distance sales of Armond products.

  • by telephone through Armond Customer Service or
  • through the armond.com website, with delivery throughout Italy.

These general terms and conditions of distance selling must be carefully reviewed by the Customer before completing the distance purchase procedure for “Armond” products. It is understood that placing a purchase order with Armond Customer Service or via the armond.com website implies full and complete knowledge of these general terms and conditions of sale and their full acceptance: by submitting a purchase order to Armond Customer Service or via the armond.com website, the Customer unconditionally accepts and undertakes to comply with these general terms and conditions of sale in their dealings with Armond, these general terms and conditions of sale, as well as the payment terms set out below, declaring that they have read and accepted all the information provided to them, and also acknowledge that Armond is not bound by any terms and conditions other than these unless previously agreed in writing.
These general terms and conditions of distance selling may be printed and stored by anyone who has visited the armond.com website and are to be considered applicable and in force as long as they are accessible from the armond.com website. Any removal of these general terms and conditions of distance selling from the armond.com website shall automatically and irrevocably render them inapplicable, ineffective and unenforceable against Armond in relation to purchases made after their removal from the website, even if these general terms and conditions are still available and/or accessible to the public through websites other than the one indicated above.

ARTICLE 1: PRODUCT INFORMATION

Information regarding Armond products available for distance selling through Armond Customer Service and/or the armond.com website is also available from Armond, along with the relevant reference numbers. This information is provided in accordance with applicable laws and, in particular, Articles 49 and 51 of the Consumer Code.

ARTICLE 2: ORDERING PRODUCTS

Orders can be placed in Italian:

Armond Customer Service, by calling +39 0423 925011, Monday to Friday, from 9:30 a.m. to 5:00 p.m., excluding public holidays; or via the website fashion.armond.com

With regard to orders placed on the armond.com website, purchases can also be made without prior registration and creation of a personal customer account, by following the steps and instructions specified on the website itself. Before proceeding with the order, the customer will be asked to identify and correct any data entry errors.

Armond reserves the right to evaluate the acceptance of orders received. It will notify the Customer if it is unable to accept the order within 30 days from the day following the date on which the Customer sent the order to Armond and will refund any sums already paid by the Customer to Armond in relation to the order.

In order to ensure better service and availability of our products, Armond limits the quantity of products that can be purchased as follows: no more than 3 items, of which a maximum of 2 may be the same product, per transaction.

ARTICLE 3: PRODUCT PRICES

  1. Product prices are inclusive of all taxes and duties as well as standard shipping costs (see Article 5.3 below), unless, for orders placed via the armond.com website, otherwise indicated on the aforementioned website or on the order screen, or, for orders placed by telephone with Armond Customer Service, otherwise communicated by Customer Service before the Customer confirms the order.
  2. The price of each product is communicated to the Customer when they call Armond Customer Service or, in the case of purchases made on the armond.com website, before the contract is concluded. All prices are expressed in euros and include VAT.
  3. In accordance with the provisions of Article 51, paragraph 7 of the Consumer Code, after concluding the contract, the Customer shall receive written confirmation of the product ordered, its price, the amount paid, the existence of the right of withdrawal (except in cases where this right is excluded – see Article 6) – with an indication of the timing and methods for returning the goods – the geographical address for submitting any complaints, information on assistance services, existing legal and commercial guarantees and the possibility of using extrajudicial complaint and redress mechanisms pursuant to Article 141 of the Consumer Code.

SUMMER SALE 3.1

The sales will run from 5 July to 31 August 2025 with progressive discounts of up to 30%. Promotional codes can be used in addition to the sales discounts, unless otherwise specified.

ARTICLE 4: PAYMENT TERMS

Payment by the Customer may be made, both for purchases made through the Armond Service and for purchases made through the armond.com website, by:

  1. Credit card;
  2. PayPal,
  3. Bank transfer from an Italian bank account in the name of the person making the purchase.

The following credit cards are accepted: Visa, Mastercard, American Express.
The Customer’s credit card will be charged when the order is prepared for shipment. For payment purposes, the Customer confirms to Armond Customer Service or via the armond.com website that they are the holder of the credit card indicated and that the name on the credit card is theirs; then, at their discretion, they shall communicate by telephone or secure email or, in the case of purchases made through the armond.com website, on the website itself, the number, expiry date and security code indicated on their credit card. If, for any reason, the amounts due from the Customer are not charged, the sale process is automatically cancelled and the sale is automatically cancelled.

If, when placing the order, the Customer has indicated that they wish to pay by bank transfer, Armond will send them an email with the bank details for the transfer. Payment must be received by Armond within 5 days. The products will be prepared for shipment as soon as payment has been received: if payment has not been received within 5 days, the order will be considered cancelled. For security reasons, the invoice holder must be the same as the bank account holder. Otherwise, we will not be able to accept your order.

ARTICLE 5: DELIVERY

Products will be delivered to the address specified by the Customer only after payment for the order has been duly registered. In accordance with the provisions of Article 61 of the Consumer Code, Armond will fulfil the order for the products no later than 30 days from the date of conclusion of the contract, upon receipt of the purchase price, unless Armond communicates – within the same period – the non-acceptance of the order in accordance with Article 2.2 above.

The Customer may choose from the following delivery methods:

Standard service (free of charge): delivery is made between 8:00 a.m. and 6:00 p.m. from Monday to Friday (delivery within 3-4 working days);

Il Cliente verrà informato a mezzo SMS o e-mail della data di consegna prevista nonché del nominativo e dei contatti del vettore incaricato da Armond per la consegna medesima.

Nel caso in cui, al momento della consegna, l’aspetto esteriore del pacco presenti delle imperfezioni, il Cliente (o la persona che ha ricevuto il prodotto ai sensi del precedente 5.1 ultimo comma) deve procedere all’apertura del pacco stesso in presenza del trasportatore, per verificare lo stato del prodotto ivi contenuto. Nel caso in cui il prodotto si presenti danneggiato, il Cliente (o comunque il ricevente) deve dettagliare per iscritto, sulla bolla di consegna, tutti i danni rilevati. Eventuali reclami dovranno essere inoltrati con le modalità previste dal successivo articolo 9.

ARTICOLO 6: LIMITAZIONE DI RESPONSABILITÀ

Al di fuori dei casi di dolo o colpa grave, Armond non sarà responsabile nei confronti del Cliente ad alcun titolo in conseguenza di:

  1. danni o perdite causati dai prodotti (o dal loro utilizzo da parte del Cliente), ferma restando in ogni caso l’applicazione delle norme inderogabili di legge in materia di responsabilità del produttore;
  2. danni che non siano stati cagionati da inadempimento di Armond;
  3. perdita di affari o di opportunità di commercio che non sia stata cagionata da inadempimento di Armond.

Nessuna disposizione delle presenti condizioni generali di vendita potrà limitare la responsabilità in caso di morte o danno alla persona del Cliente causati dalla negligenza di Armond, dei suoi dipendenti, agenti o incaricati.

Fatto salvo quanto previsto in altre disposizioni delle presenti condizioni generali di vendita, Armond riparerà o sostituirà gratuitamente qualsiasi prodotto che sia stato danneggiato o smarrito in occasione della spedizione effettuata dal proprio spedizioniere, a condizione che:

  1. il Cliente abbia comunicato per iscritto il danneggiamento o lo smarrimento entro le 24 ore successive alla data di consegna (nel caso di danneggiamento) ovvero entro le 24 ore successive alla data di consegna che era stata indicata al Cliente in conformità al precedente articolo 5.4 (nel caso di perdita) al fine di consentire a Armond di avvalersi dei rimedi previsti dalle condizioni di spedizione applicate dallo spedizioniere e il Cliente metta a disposizione di Armond (in caso di danneggiamento del prodotto) la ricevuta o altro documento relativo al prodotto in questione, nonchè il prodotto unitamente alla confezione originale ed a tutti gli accessori, cartellini, ecc. relativi al medesimo.

ARTICOLO 7: DIRITTO DI RECESSO – ISTRUZIONI PER L’ESERCIZIO DEL DIRITTO DI RECESSO

Armond è consapevole del fatto che i Clienti non soddisfatti dei prodotti ricevuti, salvo nei casi previsti dall’art. 59 del Codice del Consumo, possono esercitare il diritto di recesso previsto dal Codice del Consumo, Capo I, titolo III, parte III ed in particolare dai suoi articoli da 52 a 58. E’ interesse di Armond che il Cliente possa esercitare detto diritto di recesso nelle migliori condizioni possibili.

Il Cliente può esercitare il recesso, senza specificarne le ragioni, comunicando a Armond, nel termine massimo di 14 giorni (quattordici) dal ricevimento del prodotto presso l’indirizzo indicato all’atto dell’ordine, la sua intenzione di recedere dal contratto e di restituire il prodotto medesimo.

Al fine di esercitare il proprio diritto di recesso, il Cliente può comunicare la propria volontà esclusivamente attraverso una delle seguenti modalità:

(i) tramite l’apposito form online

(ii) mediante invio di una email all’indirizzo [email protected], contenente la dichiarazione di recesso, i dati del Cliente e l’indicazione del prodotto interessato. A tal fine il Cliente, se lo desidera, può utilizzare il modulo tipo reperibile in calce alle presenti condizioni generali di vendita (Allegato A).
Non saranno accettate altre modalità di comunicazione del recesso.

In conformità all’art. 54 co. 4 del Codice del Consumo, resta a carico del Cliente l’onere della prova relativa all’esercizio del diritto di recesso. Il Cliente sarà inoltre responsabile della tempestiva restituzione del prodotto per il quale lo abbia esercitato.

In qualsiasi modo eserciti il recesso, il Cliente potrà usufruire del servizio gratuito di ritiro a domicilio in Italia dei resi offerto da Armond, chiamando il Servizio Clienti Armond per concordare la data del ritiro, che dovrà essere compresa nei 14 giorni decorrenti dalla data di ricevimento da parte di Armond della dichiarazione di recesso del Cliente. Il Cliente dovrà consegnare il prodotto per il quale ha esercitato il recesso al corriere nella data e orario così concordati. Nel caso di sua impossibilità, egli potrà concordare un nuovo accesso del corriere, che dovrà avvenire entro i successivi 7 giorni. Si precisa che i prodotti vengono ritirati nei giorni feriali tra le ore 8:00 e le ore 18:00.

Per garantire un rapido trattamento del reso e assicurare la sicurezza del prodotto restituito durante il trasporto, Armond consiglia vivamente ai Clienti di utilizzare i suoi servizi di reso gratuiti descritti sopra (servizio di ritiro resi a domicilio). Tuttavia, se il Cliente non potesse o volesse beneficiare di tali servizi, potrà restituire il prodotto, sotto la sua esclusiva responsabilità, attraverso un vettore di sua scelta. Il prodotto dovrà essere inviato entro 14 giorni dalla data in cui il Cliente ha comunicato a Armond il recesso, al seguente indirizzo: Armond S.R.L. – sede legale Via Nome di Maria, 24 31010 Maser (TV). Il Cliente dovrà in tal caso sostenere le spese di spedizione per la restituzione del prodotto, come addebitate dal servizio postale o dal corriere prescelto e tali spese non saranno rimborsate da Armond.

I prodotti devono essere restituiti nel loro imballaggio originale, con tutti gli accessori, istruzioni, etichette, coperture protettive e scatole, unitamente ad una copia della comunicazione di recesso.

In caso di recesso, saranno rimborsati al Cliente tutti i pagamenti effettuati a favore di Armond in relazione al prodotto per il quale il recesso è stato esercitato, compresi i costi di consegna, salvo per quelli supplementari derivanti dall’eventuale scelta dei tipi di consegna speciali descritti all’art. 5.3 (ii) e (iii) di cui sopra).

Il rimborso di tali pagamenti avverrà mediante riaccredito nel termine di 30 giorni dalla data in cui Armond è venuta a conoscenza dell’esercizio del diritto di recesso da parte del Cliente. Ai sensi dell’art. 56 co. 3 del Codice del Consumo, tuttavia, qualora il Cliente provveda personalmente alla restituzione del prodotto (ovverosia non si avvalga del servizio di ritiro a domicilio in Italia), Armond potrà trattenere il rimborso del relativo prezzo fintantoché non avrà ricevuto il prodotto reso o il Cliente non abbia dimostrato di averlo spedito nei termini previsti. Parimenti, Armond potrà trattenere il rimborso del prezzo sino alla data di presa in consegna del prodotto qualora il Cliente richieda il servizio di ritiro a domicilio in Italia ma non provveda a consegnare il prodotto nella data e ora concordati con il Servizio Clienti Armond. Resta in ogni caso salvo quanto previsto all’ultimo paragrafo del presente articolo.

Il riaccredito di cui al precedente punto verrà effettuato sul conto corrente del Cliente corrispondente alla carta di credito utilizzata dal Cliente stesso per il pagamento, ovvero, qualora il pagamento sia stato effettuato mediante bonifico bancario, sul conto corrente sul quale è stato a suo tempo addebitato il prezzo dei prodotti. Tale rimborso non comporterà alcun costo per il Cliente.

Secondo quanto previsto dall’articolo 57 co. 2 del Codice del Consumo, il Cliente è responsabile della diminuzione del valore dei prodotti dovuta a manipolazione diversa da quella strettamente necessaria a valutarne la natura, le caratteristiche e l’effettivo funzionamento.
Pertanto, qualora i prodotti restituiti dal Cliente risultino danneggiati, incompleti, deteriorati e/o sporchi o in qualunque stato che lasci inequivocabilmente intendere che siano stati utilizzati, in modo tale da comprometterne la sostanziale integrità, essi non verranno rimborsati. Con specifico riguardo alle calzature, la suola deve essere perfettamente intatta: si raccomanda pertanto fortemente ai Clienti di provare le calzature Armond su di una superficie particolarmente morbida e non abrasiva.

La mancata restituzione del prodotto entro i termini sopra indicati o la sua mancata consegna al corriere incaricato da Armond nella data e orario concordati (se del caso posticipati come sopra previsto) sarà intesa quale manifestazione da parte del Cliente della volontà di revoca della dichiarazione di recesso. Il Cliente tratterrà quindi il bene acquistato, e Armond non sarà tenuta ad alcun rimborso.

ARTICLE 8: PRODUCT REPLACEMENT

Armond wishes to offer its customers the option of replacing products purchased remotely, either through Armond’s Customer Relations Service or via the armond.com website.

The replacement of products purchased remotely is subject to the following restrictions:

in the event of a replacement request submitted to Armond Customer Service:

The replacement of products purchased remotely may be carried out with other replacement products of equal or greater value than the products purchased: in the latter case, the Customer shall pay the difference in price.

The replacement of products purchased remotely may also be carried out with other substitute products, even if they are of lower value than the products purchased. In this case, Armond will refund the Customer the difference in price. The refund will be made using the payment method previously chosen by the customer.

Within 14 days of the delivery date, the Customer may choose to:

request replacement of the product purchased remotely by calling Customer Relations. Armond offers a free service, as described in Article 6 above, for the return of the product to be replaced by the Customer. However, the Customer may still choose to return the product at their own expense, using the methods described in Article 6 above. In this second case, the Customer is responsible for providing proof of return of the products, which must therefore be returned by registered post with return receipt. Regardless of the return method chosen, the transport costs for the new product will be borne by Armond. It is understood that Armond will not ship the replacement product before receiving the items returned by the Customer. The provisions of Article 6 above shall apply mutatis mutandis.

Products returned by the Customer that are damaged, incomplete, deteriorated and/or dirty, or in any condition that clearly indicates that the products have been used in such a way as to compromise their substantial integrity, will not be replaced.

With specific regard to footwear, the sole must be perfectly intact: Armond strongly recommends that customers try on Armond footwear on a particularly soft, non-abrasive surface.

In the event of replacement, the sale relating to the replaced product shall be considered terminated. Payment for the replacement product shall be made by offsetting the amount against the price of the previous sale. It is understood that any amount exceeding the Customer’s debit or credit balance, within the limits set out in paragraph 7 above, shall be debited or credited to the Customer’s current account, corresponding to the current account or credit card used by the Customer for payment.

If the Customer has used the replacement service for a product that was itself received as a replacement (except in cases of replacement due to product non-conformity) for another product previously purchased, Armond reserves the right to refuse further replacements.

ARTICLE 9: CONFORMITY – WARRANTY

The Customer is required to verify that the products received correspond to those ordered. If the products delivered do not comply with the order, the Customer must inform Armond Customer Service by telephone and return the products in question. In this case, the provisions of Article 6 of these general terms and conditions of sale shall apply, where compatible.

In addition to the specific warranties provided to the Customer together with the delivered product, the sale of Armond products is also subject to the legal warranties provided for by Italian law and, in particular, those provided for and governed by Articles 128, 129, 130 and 132 of the Consumer Code.

ARTICLE 10: COMPLAINTS – INFORMATION

For any information or complaints, or for any questions regarding Armond’s general terms and conditions of sale by mail order or Armond products, customers should contact the company’s Customer Service Department by telephone on +39 0423 925011 or by writing a message via the “Send your email now” section in the “CUSTOMER SERVICE” area, indicating the order number to which the query refers.

ARTICLE 11: INTELLECTUAL PROPERTY RIGHTS

The “Armond” trademark, as well as all figurative and non-figurative trademarks and, more generally, all other trademarks, illustrations, images and logos appearing on Armond products, related accessories and/or packaging, whether registered or not, are and remain the exclusive property of Armond Srl – Maser (TV). The total or partial reproduction, modification or use of these trademarks, illustrations, images and logos, for any reason and on any medium, without the prior express agreement of Armond Srl is strictly prohibited. Any combination of the aforementioned trademarks with other trademarks, symbols, logos and, more generally, any distinctive sign suitable for creating a composite logo is also prohibited. The total or partial reproduction, modification or use of designs, models and patents that are the exclusive property of Armond is also strictly prohibited.

ARTICLE 12: FORCE MAJEURE

The performance of services by Armond may be suspended in the event of unforeseeable circumstances or force majeure that prevent or delay their performance. Such events include, but are not limited to, war, riots, insurrections, strikes and supply problems affecting Armond attributable to third-party suppliers, or the Customer providing an incorrect shipping address. Armond shall inform the Customer of the occurrence of unforeseeable circumstances or force majeure within 7 days of their occurrence. If the suspension of the service lasts for more than 15 days, the Customer shall have the option to cancel the order and shall be refunded any amounts already paid, in accordance with Article 6 of these general terms and conditions of sale.

ARTICLE 13: JURISDICTION AND APPLICABLE LAW

The jurisdiction applicable to sales contracts concluded by telephone or through the Armond website is that provided for in Article 66-bis of the Consumer Code. For the resolution of disputes, it is possible to resort to the mediation procedures provided for by Legislative Decree No. 4 of 4 March 2010. 28. This is without prejudice to the possibility of promoting out-of-court dispute resolution, as provided for in Articles 66 and 141 of the Consumer Code.

We inform the Customer that the European ODR platform for the out-of-court settlement of disputes concerning contractual obligations arising from online sales or service contracts between a consumer residing in the European Union and a professional established in the Union, provided for by EU Regulation No. 524/2013, is available at the web address www.ec.europa.eu/consumers/odr/.

The law applicable to sales contracts governed by these general terms and conditions is Italian law, excluding conflict of law rules and, in any case, rules of private international law. The applicability of the 1980 Vienna Convention on the sale of goods is also excluded.
